1. The Expanded Concept of Documents & Evidence

The foundational definitions of evidence have been overhauled under Section 2 of BSA 2023:

Statutory Inclusions in Documentary Evidence

  • Section 2(1)(d) - Document: Expansively defines documents to include electronic records, electronic mail, server logs, mobile text messages, digital audio recordings, CCTV and body-worn footage, semiconductor memory files, and cloud-stored data.
  • Section 2(1)(e) - Evidence: Explicitly recognizes statements made before court through electronic means (video conferencing) as oral evidence, and all electronic records produced for court inspection as documentary evidence.

2. Primary vs Secondary Evidence Reforms (Sections 57 & 58)

Under the historical Evidence Act, proving computer output was strictly confined to secondary evidence with cumbersome technical hurdles. The BSA simplifies this under Section 57:

Primary Evidence Recognition: Where an electronic record is created or stored across multiple files, distributed computer servers, or redundant cloud repositories, each duplicate generated simultaneously by an automated digital process constitutes primary evidence. Video recordings stored simultaneously across multiple video surveillance hard drives are treated as primary evidence in trial.

3. Section 63 BSA: The Modern Certificate Framework

Where secondary electronic evidence is produced (such as USB drive copies, printouts, or extracted forensic excerpts), Section 63 retains the substantive safeguards of old Section 65B while introducing a structured Schedule Certificate:

  • Schedule - Part A (Custodian Certification): Signed by the owner, custodian, or manager of the device or server, certifying that the device was operating lawfully and in the ordinary course of business.
  • Schedule - Part B (Technical Expert Certification): Signed by a qualified cyber forensic expert or software engineer confirming hash value integrity, bit-stream duplication, and absence of manual tampering.

4. Presumptions Relating to Digital Communications

Sections 84 through 88 of BSA 2023 create modernized legal presumptions:

Statutory Presumptions on Digital Records

Section 84: Presumption as to electronic agreements entered into by digital signature or electronic authentication.

Section 85: Presumption as to electronic records and digital signature certificates issued by licensed Certifying Authorities.

Section 86: Presumption as to electronic messages transmitted through telecom service providers (presuming the message corresponds with what was fed into the device, though without presumption as to the sender's identity without proof).

5. Accomplice Evidence & Confessions

Section 23 of BSA retains the strict prohibition that no confession made to a police officer shall be proved as against a person accused of any offence. However, Section 23(2) preserves the discovery rule (old Section 27 Evidence Act): so much of such information as relates distinctly to the fact thereby discovered is admissible in trial.

Frequently Asked Questions on BSA 2023

No. In accordance with Section 57 of the BSA and the Supreme Court Three-Judge Bench decision in Arjun Panditrao Khotkar, if the original device containing the digital record is directly produced into the custody of the court for examination, it is primary evidence and does not require a Section 63 certificate.

Under Section 39 of the BSA 2023 (Opinion of Examiner of Electronic Evidence), the opinion of an Examiner of Electronic Evidence referred to in Section 79A of the Information Technology Act, 2000, is a relevant fact regarding any matter transmitted or stored in computer resources.
